8/8/24 – Staff Assault – Earnest C. Brooks Correctional Facility

On August 8, 2024, at 2209 Hrs., Officer A was conducting sanction showers in Dublin Unit when he observed Prisoner 1 on A wing refusing to return to his cell. Officer A approached Prisoner 1 giving him a direct order to return to his cell.

Prisoner 1 makes direct eye contact with Officer A and states, “I’ll beat your ass right now”! Officer A gives Prisoner 1 a direct order to place his hands behind his back and comply with restraints.

Officer A approaches Prisoner 1, attempting to place him in restraints. Prisoner 1 turns towards Officer A clinches his right fist and strikes Officer A in the right side of his face. Officer A steps away from Prisoner 1, creating distance, and calls over his institutional radio “STAFF ASSAULT IN DUBLIN”!

Prisoner 1 advances towards Officer A, striking him in the head and face area with three more closed fist strikes throwing him to the floor of A wing causing Officer A’s Fox Five Point Three Chemical Agent to dislodge from his belt.

Prisoner 1 lunges at Officer A as he is attempting to stand and kicks him in the left shoulder. Officer A brings his hands up to a high guard, blocking the strike and knocking Prisoner 1 to the floor.

Officer A returns to a standing position, removing his Electronic Control Device #27 from his holster as Prisoner 1 retrieves Officer A’s chemical agent from the floor.

Officer A gives Prisoner 1 a loud verbal command to “DROP IT AND GET ON THE GROUND”! Prisoner 1 refuses to comply with Officer A’s orders. Officer A deployed cartridge #1 missing the targeted area and immediately followed up with cartridge #2 striking him in the lower back and buttocks causing Neuromuscular Incapacitation (NMI) and causing Prisoner 1 to drop the can of chemical agent and fall to the floor.

Officer A immediately approaches Prisoner 1 and places him in a three-point restraint technique, applying restraints to Prisoner 1’s wrists, and maintaining control until additional staff respond to the area.

Sergeant B and Officer C respond to A wing of Dublin Unit assisting Officer A and take over the escort placing Prisoner 1 in a shoulder pin escort technique.

Sergeant B instructs Officer D to take over the escort from A wing to Segregation.

Officer E responds to Dublin Unit yard, taking over the escort from Officer C.

Prisoner 1 is escorted through the North Door of Segregation to the Segregation Corridor and placed in the Emergency Restraint Chair (ERC).

Sergeant F secures Prisoner 1 in the ERC and places it against the wall in a safe direction.
